The UP High Court revoked the penalty order by the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) on a realty firm for the delay in registering the ongoing projects.
The UP RERA ordered a penalty of 1% of the project cost on Unitech group Pvt. Ltd. The firm challenged this order in the Lucknow High Court and said that the company tried to make the payment, but due to the downturn of the RERA UP website the same was not processed.
The lawyer defending Unitech further stated that the last date for registering the projects with RERA was 15th August. The company tried to make payments from August 11 to August 15 but was not able to do as the UP RERA website was not accepting payments. Further, the company tried to make payment on 16th August, but a penalty of 1% of the project cost which was in crores, added to the registration fee .
On hearing the plea, the Lucknow bench of High court comprising Justice Vikram Nath and Justice DS Tripathi gave their decision in favour of the realty firm. The court asked Uttar Pradesh RERA to revoke the penalty on Unitech for late registration, giving a relief to the company.
