RERA Gujarat

Gujarat RERA also known as GUJRERA is a part of the Real estate (Regulation and Development) act established in 2016. RERA (Real estate regulation authority) aims at protecting homebuyers, which will also in turn help boost the real estate sector. Each state in India has RERA, and this body helps in resolving any disputes with regard to real estate as well.

Features of RERA Act, 2016:

 

  • Establishing Real Estate Regulatory Authority in every State and Union Territory.
  • To appoint adjudicating officers for settling all disputes and imposition of interest.
  • Compulsory registration of the projects, and agents who wish to sell any apartment, building or plot.
  • Mandatory disclosure of all projects and its details like layout plan, name of the promoter, land status, statutory approval status, architect, contractors, engineer, etc.
  • Mandatory deposit of 70% of the total value paid by the allottees in a different account within a period of fifteen days for covering construction cost.
  • Establishment of the Real Estate Appellate Tribunal in order to hear the appeals from the adjudicating officer and orders of the Authority. The head of the Appellate Tribunal must be a retired or sitting judge of the High Court assisted by a technical/administrative member and a judicial member

    Gujarat RERA Return Filing Process

    The RERA Act dictates that the promoter or builder of a project will have to update all the details of a particular project on or before seven days of the end of each quarter. Apart from merely updating the details of a project, the promoter will also be accountable for all the updates posted on the RERA portal.

    The process for return filing is simple and easy for a promoter or agent. One must simply follow the 5 step process mentioned below:

  • Login to the GUJRERA portal as an agent/promoter – Login to the homepage by typing in your credentials.
  • Enter unique block entry for inventory – Enter the total number of unique block/bungalow/wing/type/category of the project phase which was registered under Gujarat RERA. Subsequently, click on confirm. This will take you to a new page wherein you will be able to enter the details of the project. Click on submit after this.
  • Dashboard quarter view – This dashboard contains 4 boxes representing the four quarters in a year. These boxes are labelled Q1, Q2, Q3, and Q4. Only the current quarter will be active. Meaning that a promoter will not be able to file on any other quarter except for the present quarter. However, the final quarter will also be available to file if in case the project has reached completion beforehand.
  • Active quarter and payment – This gateway allows you to make payments on return filings. However, payments can be made only on active quarters.
  • RERA quarterly return – Finally, you can click on RERA quarterly return to begin the filing process for the respective quarter.

    Stage 1 – Promoter details – The first step in registering your project in GUJRERA is to register the project on the portal. In this case, a promoter can be either an individual or a society. Either way, all the details would have to be filled as requested on the portal.

    Stage 2 – Project details – After entering the promoter details, the details of the project would have to be entered into the portal.

    Stage 3 – Upload documents – Post filling all the details into the portal, the promoter must then upload the documents requested by the portal. These will include documents such as balance sheet, profit and loss statement, cash flow statement, etc.

    Step 4 – Payment – The final step in registering a project is to make the necessary payments in order to successfully register the project.

    In order to file a complaint in the RERA portal, follow the steps mentioned below:

  • Login to the official GUJRERA website
  • Click on ‘Complaint registration’
  • This will prompt you to fill in a form w
  • where you can file proceeds
  • Fill in the form and click on ‘Submit’
  • This will then open a confirmation page with an acknowledgement number
  • Make note of this number and use if for future reference

    Agent Registration Process for RERA Gujarat

  • Login to the official GUJRERA website
  • Click on ‘Agent registration’
  • This will prompt you to choose one of two options – ‘Individual’ or ‘Societies/Company/Partnership firm/ Competent authority/ Limited liability partnership/ Trust’
  • Click on either one and enter your e-mail ID
  • Fill in the all the agent details as prompted by the portal
  • Upload the documents requested by the portal
  • Make the payment using the gateway provided by the portal
  • Fill in the form and click on ‘Submit’
  • This will then open a confirmation page with an acknowledgement number
  • Make note of this number and use if for future reference

  • Click on ‘Know your RERA application status’
  • Type in the acknowledgement number
  • Type in your PAN
  • Click on ‘Search’
